Rental Contract
1. GENERAL PROVISIONS & WARRANTIES
- Liability Charge Per Incident: All loss and damage per incident, and each separate event leading to loss or damage, is strictly subject to the damage liability charge per incident.
- Summons and Legal Papers: You must promptly report any incident involving loss or damage to the vehicle to the Drive Rental Co. location where the vehicle was hired and deliver every summons or complaint immediately.
- Police Reporting: Compliance with reporting to Drive Rental Co. does not excuse the hirer from the legal obligation of reporting all accidents and incidents directly to the police.
- Personal Property Liability: You release and hold harmless Drive Rental Co. from all claims for loss or damages to your personal property left in the vehicle at any time.
- Exclusion of Warranties: DRIVE RENTAL CO. GIVES NO EXPRESS OR IMPLIED WARRANTY AS TO ANY MATTER WHATSOEVER, INCLUDING THE CONDITION OF THE VEHICLE, ITS MERCHANTABILITY, OR FITNESS FOR ANY PARTICULAR PURPOSE.
2. FUEL POLICY
- Full Tank Return Requirement: Cars must be completely full of fuel upon return to the company.
- Refuelling Penalty Charges: Failure to return the vehicle with a full tank of fuel will incur a mandatory filling charge of $22.00 plus a fuel fee of $2.50 per litre for the missing volume.
3. VEHICLE CONDITION, MAINTENANCE & RETURN
- Return Condition: You agree to return the vehicle in the same operating condition, except ordinary wear and tear (WHICH ABSOLUTELY DOES NOT INCLUDE WINDSCREEN OR TYRE DAMAGE).
- Unsealed Road Restrictions: Vehicles are strictly not to be driven on beaches, dirt roads, or gravel surfaces.
- Daily Inspections: The hirer must check fluid, water, and engine oil levels daily.
- No Animal Policy: No animals or pets are allowed in the vehicles under any circumstances unless authorized in writing.
- Unauthorized Repairs: The hirer agrees that no repairs are to be carried out and no costs are to be incurred on the owner's behalf without first obtaining the written authority of Drive Rental Co.
4. ACCIDENTS & TRAFFIC VIOLATIONS
ALL ACCIDENTS MUST BE REPORTED IMMEDIATELY TO THE POLICE AND DRIVE RENTAL CO. AND MUST BE ACCOMPANIED BY AN OFFICIAL POLICE REPORT.
- Hirer's Total Responsibility: You are entirely responsible for all traffic violations, toll usage, parking tickets, and traffic fines incurred during the hire period.
- Administration Fees: Drive Rental Co. charges a mandatory $33.00 administration fee for processing speeding fines, parking fines, and unpaid toll usage that are not declared upon check-in.
5. FEES, LATE RETURNS & TERMINATION OF HIRE
- Cleanliness Standard: Vehicles must be returned clean and tidy. A minimum cleaning fee of $70.00 will be charged if the vehicle requires professional cleaning.
- Late Return Fees: Late returns will be penalized and charged at a rate of 1/5th of the daily rental rate per hour past the agreed return window.
- Stolen Vehicle Reporting: Drive Rental Co. must agree to any extension of the hire period in advance, or the vehicle will be immediately reported to the authorities as stolen.
6. UNAUTHORIZED AND PROHIBITED USE
Persons who must NOT drive the vehicle:
- Any person who is not identified and approved on Page 1 of the rental contract.
- Any person who is not licensed for that specific class of vehicle or whose license was suspended in the last 3 years.
- Any person whose blood alcohol concentration exceeds the lawful legal percentage.
Circumstances in which the vehicle must NOT be used:
- Outside the area of use limitations shown on Page 1 of the contract.
- For racing, pacemaking, reliability trials, speed trials, hill climbing, or testing.
- In a dangerous, reckless manner, or for any illegal purpose.
7. DAMAGE/LOSS LIABILITY & EXCESS PACKAGES
- Drivers Aged 21–25: Drivers between the ages of 21–25 years old are subject to a standard damage liability excess of $7,000.00.
- Drivers Aged 25+: Drivers over the age of 25 have a varying damage excess depending on the specific liability option chosen.
- Single Vehicle Accident Excess: Any single-vehicle accident carries a fixed standard excess of $5,000.00.
8. FINANCIAL OBLIGATIONS & CARD AUTHORIZATION
- Credit Card Debit Authorization: You explicitly authorize Drive Rental Co. to debit your credit card, debit card, or security deposit with all rental charges, traffic fines, and any under-body, interior, or water immersion damages.
- Third-Party Billing: If you direct the company to bill charges to a company or corporation that fails to make payment, you will immediately pay the full amount due on demand.
